Terms of Use

These Terms of Use ("Terms") govern your access to and use of the P3D Works website, services, and marketplace (collectively, the "Platform"). By creating an account or using the Platform, you agree to be bound by these Terms. Please read them carefully.

1. About P3D Works

P3D Works is an online marketplace that connects people who need 3D printed items ("Buyers") with independent 3D printing service providers ("Sellers") across Australia. The Platform is operated by P3D Works Pty Ltd (ACN 700 291 701, ABN 91 700 291 701), a company registered in Australia and trading as P3D Works ("P3D Works", "we", "us", or "our").

References to "Members" in these Terms means both Buyers and Sellers. References to "you" means the Member reading these Terms.

2. Accepting These Terms

By creating a P3D Works account, browsing the Platform, posting a print request, submitting a quote, or completing a purchase, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

You must be at least 18 years of age to use the Platform. By using the Platform, you confirm that you are 18 or older and that you have the legal capacity to enter into binding contracts.

If you are using the Platform on behalf of a business, you represent that you are authorised to bind that business to these Terms.

3. Your Account

To access most features of the Platform, you must register for an account. You agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain the security of your password and not share it with anyone.
  • Promptly notify us at [email protected] if you suspect any unauthorised access to your account.
  • Be responsible for activity under your account to the extent it results from your failure to keep your login details secure, and tell us promptly if you suspect unauthorised access.
  • Not create more than one personal account, or create an account for anyone other than yourself.
  • Not transfer your account to any other person.

We reserve the right to reclaim usernames that are inactive, misleading, or that infringe another party's intellectual property rights.

4. P3D Works as a Venue

P3D Works is a marketplace platform. Except where an item or quote is clearly marked as offered by P3D Works or an Official seller account operated by us, the contract for the printed item is between the Buyer and the Seller. Third-party Sellers are independent businesses or individuals, not employees or agents of P3D Works.

For a third-party Seller's item, the Seller is responsible for the item, its description, safety, delivery and any applicable consumer guarantees. Where P3D Works supplies an item itself, P3D Works is the supplier and is responsible for its obligations under the Australian Consumer Law. We do not inspect or guarantee third-party Seller items merely because they are offered through the Platform.

However, P3D Works does:

  • Provide a payment processing service that holds Buyer funds until order completion.
  • Operate a dispute resolution service to assist Members who cannot resolve issues directly.
  • Establish and enforce Community Standards to maintain the quality and safety of the marketplace.
  • Investigate reported violations and take enforcement action where appropriate.

5. Buying on P3D Works

When you post a print request or purchase a listing, you agree to:

  • Provide accurate specifications, dimensions, and requirements for your print job.
  • Pay the full quoted price, including shipping, at checkout.
  • Confirm delivery promptly and honestly once your item arrives.
  • Raise any disputes within 30 days of the delivery date.
  • Not misuse the dispute process or make false claims about items received.

Payments are processed by Stripe. For third-party Seller orders, P3D Works releases the Seller payout after the order meets the applicable completion requirements, unless the order is disputed, refunded, cancelled or subject to a fraud or chargeback investigation. This payout process is not a limitation on your rights under the Australian Consumer Law.

P3D Works does not guarantee that a print request will receive quotes, or that a quoted order will be completed within any particular timeframe unless explicitly agreed with your Seller.

6. Selling on P3D Works

By enabling seller features on your account, you agree to these additional obligations. As a Seller you agree to:

  • Only offer items you are legally able to produce and sell in Australia.
  • Provide accurate, honest descriptions and turnaround estimates in your quotes and listings.
  • Fulfil orders to the standard described in your quotes and listings.
  • Provide a tracking number and progress photographs before marking an order as shipped.
  • Respond to Buyer messages and P3D Works support requests promptly.
  • Maintain appropriate equipment and skills to fulfil orders you accept.
  • Comply with all applicable Australian laws, including those relating to product safety, consumer rights, and taxation.
  • Meet any consumer guarantees that apply to your supply, and not make misleading claims about an item, its materials, quality, safety, fitness for purpose, delivery time or price.
  • Use a Buyer's name and address only to fulfil the relevant order, keep it secure, and not use it for marketing or disclose it to another person except a carrier as needed to deliver the order.
  • Promptly cooperate with a safety investigation, recall, IP complaint, consumer claim or lawful request for information relating to an order.
  • Report your earnings and pay any applicable taxes — P3D Works does not withhold tax on your behalf.

Sellers are solely responsible for the quality, safety, and legality of the items they produce and the accuracy of their listings and quotes.

7. Fees and Payments

P3D Works charges the Seller a platform fee of 5.5% on each completed order. The applicable platform fee and whether postage is included in its calculation are shown to the Seller before the Seller submits the quote and are locked when the Buyer begins payment. Sellers also bear the Stripe processing fee shown in their payout estimate. There are no listing fees or subscription fees for standard membership.

Payments are processed by Stripe. By using the Platform, you agree to Stripe's Terms of Service. P3D Works does not store payment card details.

P3D Works may modify fees prospectively with at least 30 days' notice to active Sellers. A change will not alter the fee for an order already accepted.

8. Your Content

"Content" means any information, text, images, 3D model files, or other material you upload, post, or transmit on or through the Platform.

You retain ownership of your Content. By uploading or posting Content, you grant P3D Works a non-exclusive, royalty-free, worldwide licence to host, scan, display, transmit and use that Content solely to operate and improve the Platform and fulfil the purpose for which you submitted it. For a request or accepted order, this includes allowing relevant Sellers to inspect, technically prepare or slice the model, manufacture the requested item and ship it to you. This licence ends when we delete the Content, subject to necessary backup, legal, safety, dispute and record-keeping retention.

You represent and warrant that:

  • You own all Content you upload, or have the necessary licences and rights to upload it.
  • Your Content does not infringe the intellectual property rights of any third party.
  • Your Content does not contain malware, unlawful material, or material that is defamatory, obscene, or harassing.
  • Any 3D model files you upload do not contain or reproduce designs that are protected by third-party patents, design rights, or copyright, unless you have permission.

You are solely responsible for the Content you upload. Our file scanning or moderation does not confirm that Content is safe, accurate, legal, fit for a particular purpose, or free from third-party rights. P3D Works may remove or restrict Content where reasonably necessary to address an infringement, safety, legal or Platform risk. We will ordinarily give notice and an opportunity to respond where practical, but may act immediately where required to protect people, comply with law or prevent further harm.

9. Intellectual Property

P3D Works intellectual property. The P3D Works name, logo, website design, software, and all associated intellectual property are owned by P3D Works Pty Ltd or its licensors. You may not use our trademarks or branding without prior written permission.

Third-party intellectual property. You must not upload, request, or produce items that infringe the intellectual property rights of any third party. This includes but is not limited to: copyrighted characters, designs, or artworks; patented items; or registered trade marks. P3D Works will respond to valid takedown notices under applicable Australian intellectual property laws.

Copyright reports. To report a copyright infringement, email [email protected] with the subject "Copyright Notice" and sufficient detail to identify the infringing content and establish your ownership of the relevant rights. We may notify the uploader and allow a response or counter-notice where appropriate. Repeated or serious infringement may result in suspension or termination.

10. Prohibited Items and Conduct

The following are prohibited on P3D Works. This list is not exhaustive.

Prohibited items:

  • Weapons, weapon components, or items designed to cause bodily harm (including but not limited to firearms, firearms components, knives intended as weapons, or tasers).
  • Items that infringe any patent, copyright, registered design, or trade mark.
  • Counterfeit goods or replicas of branded products presented as genuine.
  • Items that are illegal to manufacture, sell, or possess in Australia.
  • Items containing hazardous materials not disclosed to the Buyer.
  • Drug paraphernalia.

Prohibited conduct:

  • Harassing, threatening, or abusing other Members.
  • Attempting to circumvent the Platform to transact with another Member outside of P3D Works in order to avoid fees.
  • Manipulating or falsifying reviews or ratings.
  • Creating fake accounts or misrepresenting your identity.
  • Scraping, data-mining, or automated access to the Platform without our written consent.
  • Attempting to interfere with, disrupt, or compromise the security of the Platform.
  • Posting spam or unsolicited commercial messages to other Members.

Violations may result in suspension or termination. We may place a temporary hold on a payout only where reasonably necessary to investigate a suspected breach, fraud, chargeback, safety issue or legal claim. We will give notice and an opportunity to respond where practical, and will release any undisputed amount when the reason for the hold no longer applies.

11. Privacy

Your privacy matters to us. Our Privacy Policy explains what personal information we collect, how we use it, and your rights under the Privacy Act 1988 (Cth) and the Australian Privacy Principles. By using the Platform, you agree to the collection and use of your information as described in our Privacy Policy.

12. Disputes Between Members

We encourage Members to resolve disputes directly in the first instance. If you cannot reach a resolution, you may open a dispute through the Platform within 30 days of the delivery date. This is P3D Works' internal mediation timeframe only; it does not limit any right or remedy you may have under the Australian Consumer Law.

When a dispute is opened, P3D Works will:

  • Notify both parties and invite them to provide evidence.
  • Review the evidence submitted by both sides in good faith.
  • Make a determination that may include issuing a full or partial refund to the Buyer, releasing funds to the Seller, or taking other action we consider appropriate.

P3D Works's dispute determination is final within the Platform. It does not affect either party's rights under Australian law, including under the Australian Consumer Law.

P3D Works may be unable to determine a dispute caused by an event outside our control, such as a carrier delay or damage in transit. That does not remove any right a Buyer may have against the relevant supplier or carrier under applicable law.

13. Refunds

The Platform's dispute process is intended to help Members resolve issues while P3D Works still controls the relevant funds. A Buyer may also contact the Seller directly to seek a remedy. For an item supplied by P3D Works, contact us directly. Nothing in this section limits consumer guarantees or remedies under the Australian Consumer Law.

  • Before you complete payment: a quote is not accepted and no confirmed order exists; if the payment attempt is cancelled or expires, no amount is payable and the request may reopen for another quote.
  • Before payout: if the Seller cannot complete the order, or a Platform dispute is resolved in your favour, P3D Works may issue a full or partial refund to the original payment method, including postage where appropriate.
  • After payout: P3D Works may no longer control the Seller's funds. You may seek a remedy directly from the Seller, and P3D Works may assist with information reasonably needed for that claim.
  • Change of mind: we do not offer change-of-mind refunds for custom-printed items. This does not limit rights where an item or service fails to meet an applicable consumer guarantee.

The appropriate remedy depends on the circumstances and whether a failure is major or minor. For a major failure with goods, a consumer may be entitled to choose a refund or replacement; for a minor failure, the supplier may be entitled to repair, replace or refund within a reasonable time. Refunds processed by P3D Works are returned to the original payment method and may take 5–10 business days to appear.

14. Termination

Termination by you. You may close your account at any time by contacting [email protected]. Account closure does not cancel any orders in progress or affect any outstanding legal obligations.

Termination by us. We may suspend or permanently close your account at any time if we determine, in our sole discretion, that you have:

  • Violated these Terms or any of our policies.
  • Engaged in fraudulent, deceptive, or harmful conduct.
  • Repeatedly received sustained negative feedback or dispute outcomes.
  • Created risk or legal exposure for P3D Works or other Members.

Where practical, we will give prior notice of account suspension and an opportunity to respond before a permanent closure, unless we determine that immediate action is necessary to protect Members or the integrity of the Platform.

Upon termination, your right to use the Platform ceases immediately. Sections 8, 9, 14, 15, and 18 of these Terms survive termination.

15. Limitation of Liability

To the maximum extent permitted by law:

  • For third-party Seller items, P3D Works is not responsible for the Seller's acts or omissions, including item quality, safety or legality, except to the extent P3D Works is responsible under applicable law or for its own services or conduct.
  • P3D Works is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or loss of data, arising from your use of or inability to use the Platform.
  • Subject to section 17, P3D Works's total aggregate liability for losses not arising from a non-excludable right is limited to the greater of: (a) the amount you paid to P3D Works in the 12 months preceding the claim, or (b) AUD $100.

Nothing in these Terms limits P3D Works's liability for fraud, death, or personal injury caused by our negligence, or for any liability that cannot be excluded under applicable law.

16. Indemnification

You agree to defend, indemnify, and hold harmless P3D Works, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and costs (including reasonable legal fees) arising out of or relating to:

  • Your material breach of these Terms or unlawful use of the Platform.
  • Your Content, including any claim that your Content infringes a third party's intellectual property rights.
  • Your violation of these Terms.
  • Your violation of any applicable law or the rights of another person.

17. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or other consumer protection legislation that cannot be excluded by agreement. Consumer guarantees may apply to goods and services supplied by a Seller or P3D Works, depending on the circumstances. Where a law permits a limitation of P3D Works' liability for a guarantee relating to our services or direct sales, our liability is limited only to the extent permitted by that law, and not otherwise, to:

  • In the case of goods: replacing or repairing the goods, supplying equivalent goods, or paying the cost of replacing, repairing, or acquiring equivalent goods.
  • In the case of services: resupplying the services, or paying the cost of having the services resupplied.

18. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we will notify you by email at least 14 days before it takes effect, publish the new version and update the effective date. A change will apply prospectively and will not alter an order already accepted or a payout already accrued, unless required by law or necessary to address fraud, safety or a legal obligation.

Your continued use of the Platform after the effective date of updated Terms constitutes your acceptance of those Terms. If you do not agree to the updated Terms, you must stop using the Platform and close your account before the effective date.

For significant changes, we may require you to actively accept the new Terms before continuing to use the Platform.

19. Governing Law and Disputes

These Terms are governed by the laws of New South Wales, Australia. You and P3D Works submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.

Before commencing legal proceedings, you agree to first attempt to resolve any dispute with P3D Works by emailing [email protected] and allowing 30 days for a response.

If you are an Australian consumer, nothing in this clause limits your right to approach the Australian Competition and Consumer Commission (ACCC), a state or territory consumer protection agency, or the Australian Financial Complaints Authority (AFCA) where applicable.
